TERMS & CONDITIONS

The agreement between you and us when you order. You pay cash when the food arrives, you can cancel free until the kitchen accepts the order, and if we get something wrong we fix it.

01Who we are and what this covers

CurryCook is a restaurant and delivery kitchen operating from 25958 South Knollwood, Chesterfield, MI 48051. On this site you can browse our menu, build a curry plate, create an account and place an order for delivery. These terms are the agreement between you and CurryCook whenever you do any of that.

By using this site or placing an order, you accept these terms. If you don’t accept them, please don’t place an order. Call us on (123) 456-7890 instead and we’ll take it from there.

Two other documents sit alongside this one and form part of the same agreement: our Refund & Cancellation Policy and our Privacy Policy.

02Your account

You need an account to place an order, because we need somewhere to send your order history and a way to reach you about a delivery in progress. To register you must be at least 18 years old and able to enter into a contract.

Keep your password to yourself. You’re responsible for what happens under your account, including orders placed by anyone you share your login with. If you think someone else has access, change your password and tell us straight away.

Give us accurate details. A mistyped phone number or an incomplete address is the most common reason a delivery fails, and we can’t refund an order that went to an address you gave us in error.

03Placing an order

Adding items to your cart doesn’t create a contract. When you submit an order at checkout you’re making an offer to buy, and we accept that offer when we confirm the order and start preparing it. Until that point, either of us can walk away.

Your order moves through these stages, and you can watch it happen in My Orders:

  • Pending: received, not yet accepted by the kitchen.
  • Confirmed: we’ve accepted it.
  • Preparing: it’s being cooked.
  • Out for delivery: it’s on the way to you.
  • Delivered: handed over and paid for.

We may decline an order, before or after confirming it, if an item has sold out, if the delivery address is outside the area we can reach, if we can’t reach you on the number provided, or if we have reason to believe the order isn’t real. If that happens we’ll tell you, and because you pay on delivery, there’s nothing to refund.

Menu items, curry plate components and prices depend on what’s in the kitchen that day. Occasionally something runs out after you’ve ordered. We’ll call you to agree a substitute or remove it from the order rather than deciding for you.

04Prices, taxes and payment

Prices are shown in US dollars on the item and in your cart. The total at checkout is the amount you’ll be asked for at the door. Applicable Michigan sales tax is included in that total.

Cash on delivery only

Right now, cash on delivery is the only payment method we accept. You are not charged when you place the order and we never ask for card details on this site. Payment happens once, in cash, when your food is handed to you.

Please have the amount ready if you can. Our drivers carry limited change and can’t always break large bills.

If a price is displayed incorrectly because of an obvious error, we’ll contact you before preparing the order and you can confirm at the correct price or cancel at no cost.

05Delivery

We deliver within a limited radius of our kitchen in Chesterfield, MI, during our opening hours:

  • MON - FRI: 7AM - 10PM
  • SATURDAY: 8AM - 10PM
  • SUNDAY: 8AM - 11PM

Any delivery time we quote is an estimate, not a guarantee. Weather, traffic and how busy the kitchen is all move it. We’ll always tell you if an order is running significantly late.

Someone needs to be at the address to receive the order and pay for it. If our driver can’t reach you, they’ll wait a short time, try the number on the order, and then leave. Delivery notes like “leave at the door” help us, but once food has been left where you asked, it’s with you. We can’t take responsibility for it after that.

Repeated orders that nobody answers for may mean we ask for payment in advance before delivering to that address again, or stop delivering there.

06Cancellations, refunds and problems

You can cancel an order yourself, free, for as long as it’s still Pending. Open My Orders and choose Cancel. Once the kitchen confirms your order, ingredients are committed and cooking starts, so cancellation has to go through us on (123) 456-7890.

If something is wrong with what arrives (a missing item, the wrong dish, food that isn’t in good condition), tell us and we’ll put it right. The timeframes, the remedies we offer and the handful of things we can’t refund are all set out in full in our Refund & Cancellation Policy.

07Allergens, dietary needs and food safety

Our kitchen handles nuts, peanuts, milk, eggs, wheat and gluten, soy, sesame, fish, shellfish and mustard, and it is a shared space. Dishes are cooked on shared surfaces, in shared oil and with shared equipment. We take cross-contact seriously, but we cannot guarantee that any dish is free from a given allergen.

If you have a food allergy or intolerance, please call us on (123) 456-7890 before ordering so we can tell you honestly whether we can serve you safely. A note typed into the delivery instructions box isn’t a safe way to flag a serious allergy, because it’s read by the driver rather than the kitchen.

Descriptions such as vegetarian or vegan describe the ingredients we put in a dish. They aren’t certifications and don’t rule out cross-contact.

Once your food is delivered, please refrigerate anything you don’t eat within two hours and eat it the same day. We can’t be responsible for food that’s been stored or reheated after it left us.

08Using this site properly

Please don’t:

  • place orders you don’t intend to pay for, or use someone else’s details to order;
  • try to break, overload, scrape or gain unauthorized access to any part of this site, our accounts or our systems;
  • upload anything unlawful, abusive or deliberately misleading, including in your profile or delivery instructions;
  • copy our menu, photography, descriptions or branding for a competing business.

We also ask that you treat our drivers and kitchen staff decently. Abuse or threats towards our team will end the order and your ability to order from us.

09Our content and brand

The CurryCook name and logo, the site design, our photography, menu copy and recipes belong to us or are used with permission. You’re welcome to browse, share links and print a page for your own use. Anything beyond that needs our written permission first, including reusing our images or copy commercially and presenting our brand as your own.

10Site availability and accuracy

We work to keep this site accurate and online, but we don’t promise it will be available uninterrupted or free of errors. We may change the menu, prices, delivery area or features of the site at any time, and we may take it down for maintenance. Photography is there to show the style of a dish; presentation and portion can vary from what’s pictured.

11Our responsibility to you

We’re responsible for serving you food that’s properly prepared and delivered with reasonable care and skill. If we get that wrong, we’ll put it right under our Refund & Cancellation Policy.

Beyond that, our total liability for any order is limited to the amount you paid for that order, and we aren’t liable for indirect or consequential losses, such as a missed event because a delivery ran late. Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that can’t be limited under Michigan or federal law. Some states don’t allow certain limitations, so parts of this section may not apply to you.

12Suspending or closing an account

We may suspend or close an account that breaks these terms, that’s used for fraudulent or abusive ordering, or that repeatedly leaves deliveries unanswered. Where it’s reasonable to do so, we’ll tell you why first. You can close your own account at any time by asking us. See our Privacy Policy for what happens to your data when you do.

13Changes to these terms

We update these terms from time to time: when the menu model changes, when we add a payment method, or when the law does. The current version always lives on this page with the date it last changed at the top. Changes apply to orders placed after they’re published; they never change the terms of an order you’ve already placed.

14Governing law and disputes

These terms are governed by the laws of the State of Michigan, without regard to its conflict-of-laws rules. Any dispute will be handled by the state or federal courts serving Macomb County, Michigan, and we each agree to those courts. Before it gets that far, please talk to us. Most things get resolved with a phone call.
